StubHub Settlement over Ticket Fees

A Class action lawsuit has been filed against StubHub Inc. alleging that the display of ticket fees on its websites violated California law. StubHub is an online platform where consumers can buy and sell tickets to events like sports and concerts. As per the company website, StubHub operates in 90 countries. According to the plaintiffs, the platform displayed fees for the first time during the end of the ticket purchase process. They also argued that StubHub should have disclosed that it profited from certain fees. 

Although StubHub has denied any liability or wrongdoing, it has decided to honor the class action claim for ending the hassles of ongoing litigation. This class action lawsuit is going to benefit consumers who bought tickets through the StubHub portal between 1st September 2015 and 1st September 2019. Class Members who decide not to opt-out of this class action settlement and submit a valid claim will receive either electronic cash payment or a credit towards StubHub ticket purchase in the future. 

Class Members can opt-out of or exclude themselves from the StubHub fees settlement within 17th May 2022. On excluding yourself from the Settlement, you will not be eligible for its benefits any further. You will retain your right of bringing another lawsuit against StubHub about the allegations made in this case although you will give up your right to receive an award under the Settlement or object to the same. Thus, if you opt-out of the settlement, then your objection will not be considered as you are not a part of the Settlement Class any longer.

For objecting to the terms of the settlement an objection has to be submitted to the Settlement Administrator who will file any objections with the Court for review in advance of the final approval hearing. You might request speaking in the Court about the fairness of the Settlement and objections if you do not exclude yourself from the settlement. Class Members might object at the hearing without filing an objection. Any class member can attend the hearing that is open to the public although they are not required to do so. If you do not take any action, then you will not receive a settlement award and will also give up your right to object to the settlement or participate in any other lawsuit on legal claims of this case. 

Eligibility for Making Claim: The Class comprises persons who purchased at least one ticket from 1st September 2015 to 1st September 2019 from StubHub either through the mobile or StubHub website while in California. However, the purchases made using the app on a mobile or tablet are not covered under this class action settlement

Proof Of Purchase: The email address associated with the purchase of the relevant ticket needs to be submitted by the Class Members submitting a claim. 

Potential Claim Amount: $20 million will be issued by the company in credits which will be unrestricted and valid for three years. Class Members choosing this option can expect credit between $80 to $133. StubHub will also honor valid cash claims by paying up to $2.5 million in cash. However, the amount that shall be paid to each Class Member will depend on the number of qualifying claims received by the settlement administrator. Class Members can expect to receive a maximum payment of $20 if they opt for cash payment. The payment can also be lower depending on the number of claims filed. Class Members are eligible to receive either an account credit or a cash award by submitting a valid claim form in time.

Deadline for Submitting Claim: June 25, 2022, and on submitting a claim form, you will forego your right to sue StubHub in a separate lawsuit about the claims resolved by this settlement. 

Final Hearing Date: The final approval hearing shall be held by the Court on 30th June 2022 at 2:00 p.m., in San Francisco, California.
