Deadline For Submitting Claim: Class members need to submit a claim form online or by mail postmarked within 10th August 2022 to receive a cash payment.

Proof Of Purchase: Class members can submit a credit card receipt or retailer’s receipt confirming the product purchase. Alternatively, they can submit a photo of the Child Seat displaying the product manufacturing date and serial number.

Eligibility For Making Claim: You could be entitled to the benefits of this settlement if you were a California resident who purchased either a Britax Pioneer Harness-2-Booster Seat or a Britax Frontier ClickTight Harness-2-Booster Seat for either household or personal use between the 14th August 2016 and 14th August 2020. This child booster seat should have been manufactured between 14th August 2016 and 30th September 2019.

Potential Claim Amount: Qualifying Class Members are eligible to receive a $40 cash payment. Britax will remit the payment to class members who registered their seat purchase with Britax or whose contact information is saved in Britax’s records without submitting a claim form. Unknown class members are required to submit a valid claim form for claiming the settlement benefits. There are approximately 45,608 Unknown Class Members and  21,097 Known Class Members. Britax will also pay the court-approved service award to the plaintiff, attorney’s fees and expenses, and administration and notice costs.

Britax specializes in the manufacture of various child safety products like strollers and child seats. The company describes itself as an innovator of state-of-art technologies in child accessories. However, a lawsuit has been filed accusing the company of selling two defective child car seat models:

  • Frontier ClickTight Harness-2-Booster Seat, &
  • Pioneer Harness-2-Booster Seat

According to the class-action lawsuit, the structure surrounding the top tether and the harness are capable of detaching from the seat due to a faulty hardware component connecting the steel frame with the harness. Plaintiffs who bought these products have complained that they paid more for the products than they would have if they knew about the defect. These conducts of the company violated the California state consumer and warranty laws. Britax has denied all allegations and liability, however, they stand by the safety of the Class child seats. Though Britax has asserted that the Class child seats are compliant with all applicable laws and regulations, no verdict has been passed yet by the court regarding this settlement.
