CSL Plasma Settlement for Biometric Data Breach

365 Retail and Compass are vending machine companies offering refreshments in break rooms and similar locations. These companies offer an array of micro-market solutions like touchless payment options. They have agreed to resolve claims with a $6.8 million settlement that their vending machines which required fingerprint usage violated the Illinois BIPA (Biometric Information Privacy Act). Nearly 69000 affected consumers have been included in this class action settlement according to defendant records.

Despite providing innovative vending options, the companies have been charged with unethically collecting fingerprint data from consumers and failing in complying with the BIPA in Illinois. The Biometric Information Privacy Act protects various biometric data of Illinoisans like facial geometry scans, fingerprints, and voice profiles. According to the law, companies should seek the consent of consumers before collecting their biometrics and should also comply with different disclosure and retention regulations. However, both Retail and Compass failed to comply with the disclosure and consent requirements of BIPA.

Though 365 Retail and Compass have not admitted any wrongdoing, they have agreed to resolve all claims with a $6.8 million settlement. Class members become eligible for cash payment under the terms of the deal. The total settlement fund will be reduced by the following:

  • An award of up to 1/3rd of the total settlement (estimated to be $2,266,666.67) for paying the Class Counsel’s attorney fees and litigation costs of up to $50,000.
  • A service award of $10000 shall be paid to Class Representative Christine Bryant.
  • The Settlement Administrator’s cost is estimated to be less than $120000.

After reducing these amounts, the remaining figure will constitute the settlement fund and will be distributed equally among Settlement Class members who return valid claim forms on time. However, the payment amount will depend on the number of claimants participating in the settlement. The Class counsel anticipates that each claimant might receive payments between $300 and $600. The last date for objecting to or excluding oneself from this class action settlement is 29th July 2022. Class members can contact the settlement administrator and update their information if their address changes after filing the claim.

Before paying out any money, the Court will take the final call on granting final approval of the settlement. The settlement payments will be distributed among class members who submit valid claim forms timely approximately two months later.

Eligibility For Making Claim: The terms of this settlement will benefit individuals who used 365 Retail’s or Compass’ Illinois vending systems between 23rd August 2014, and 2nd November 2021. Excluded from the Class are individuals who have chosen to exclude themselves, the Court and staff handling the case, immediate family members of the staff, or any member of the Court. These eligible vending systems were operated under names like Avenue C, Smart Market, eMart, Market Now, Honest Eats Marketplace, and NEX Micro Markets. The kiosks were placed in break rooms, canteens, and food service areas from where people could purchase food and drinks.
