3M St. John Settlement for contamination of the Tennessee River

A class-action lawsuit has been filed against 3M company, Daikin America, Inc., Dyneon, LLC, Synagro WWT, Inc., Synagro South, LLC, Toray Fluorofibers (America), Inc., BFI Waste Systems of Alabama, LLC, BFI Waste Systems of North America, LLC, The City of Decatur, Alabama, and Morgan County, Alabama. This $500000 St. John v. 3M Company class action lawsuit settlement is expected to benefit class members by ordering defendants (except Synagro WWT, Inc., and Synagro South, LLC) to provide remediation, investigation, and monitoring of Tennessee River and its nearby soils, sites, basins, groundwater, ponds, and fish. According to the claims of the plaintiffs, certain per- and polyfluoroalkyl substances (“PFAS”), including perfluorooctanoic acid (“PFOA”) and perfluorooctanesulfonate (“PFOS”) were discharged leading to the contamination. Class members are required to mail their physical claim form by post to St. John v. 3M Company Settlement Administrator, P.O. Box 43502, Providence, RI 02940-3502. To receive monetary compensation, Class Members will have to file a claim as a Sludge Application Settlement Subclass Member. The last date for objecting to or excluding oneself from this settlement is 17th March 2022.

Eligibility For Making Claim: The 3M Tennessee River contamination settlement includes all persons who owned, occupied, or had either possessory interest (through easement, lease, or joint or common tenancy) or ownership in, maintained a business of any type at, resided at, or recreated on any real property (inclusive of river Tennessee, its tributaries and all other water bodies) located in Lawrence County, Morgan County,  Franklin County, Colbert County, Limestone County,  or Lauderdale County, Alabama between 21st April 2003 and 17th December 2021. Class Members who own, occupy, or have possessory interest or ownership in real property in Franklin County, Lawrence County, Morgan County, or Limestone County, Alabama as of 17th December 2021 on which biosolids containing PFAS compounds were applied at any time are also eligible to the benefits of the Sludge Application Settlement subclass.

Potential Claim Amount: The Sludge Application Settlement Subclass members are eligible to receive monetary compensation. The settlement fund has been fixed at $50,00,000 after deducting all administration costs. This fund will be used to make payments to the Sludge Application Settlement Class members on submission of valid claim forms.
